Cloxstar - Terms and Conditions
1. Applicability
1.1 These terms and conditions apply to all offers, orders and agreements of Cloxstar.
1.2 Accepting an offer or placing an order means that you accept the applicability of these conditions.
1.3 Deviations from these conditions are only valid if they have been explicitly agreed in writing with Cloxstar.
1.4 If (a) provision (s) of the terms and conditions is / are or become null and void, the remaining provisions of these terms and conditions will remain fully in force, Cloxstar and the customer will then consult to request (a) new provision(s). And agree to replace the invalid or nullified provision (s), taking into account as far as possible the purpose and scope.
1.5 These conditions respect the rights of the consumer arising from the law (or the sales agreement).
2. Offers and agreements
2.1 All offers from Cloxstar are without obligation and Cloxstar expressly reserves the right to change the prices. All offers are based on availability.
2.2 An agreement is only concluded after acceptance of your order by Cloxstar, after the order form has been fully and correctly completed on the website of www.cloxstar.com. An agreement is concluded at the time Cloxstar sends the order confirmation to the buyer.
2.3 Cloxstar is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise.
2.4 If an order is not accepted, Cloxstar will communicate this within ten (10) days of receiving the order.
2.5 In the event that an item is not yet in stock and orders are being collected for that item, Cloxstar is not yet obliged to deliver this item, the items will be delivered as soon as it is in stock.
2.6 The buyer and Cloxstar expressly agree that a valid agreement will be established through the electronic form of communication as soon as these conditions and the order procedure have been met.
2.7 The order confirmation must at least state the following information:
A description of the product purchased by the customer, the item number, and the number of products purchased by the customer.
The price of the product in euros.
The order number of the agreement.
The e-mail address of Cloxstar, where the customer can go with questions about the order.
3. Prices and payments
3.1 The prices stated for the articles offered are in Euros, including VAT and excluding shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing. All prices are subject to price changes.
3.2 Cloxstar accepts the following payment methods:
- transfer via bank or giro account
- payment via iDeal
- payment via PayPal
- payment via credit card (VISA / MASTERCARD / MAESTRO)
- payment via Bancontact (MisterCash)
- payment via in3 (payment in 3 parts (only for Dutch customers))
3.3 Cloxstar offers the payment option payment afterwards via Billink® for Dutch customers. If you choose this payment option, the rights to the amount due for your purchases are transferred by CLOXSTAR to Billink and the payment conditions of Billink which can be viewed on the Billink website under this link: http://www. billink.nl
4. Delivery / Delivery times
4.1 The delivery period of the item is a maximum of 30 days or as much shorter than possible.
4.2 Exceeding the delivery period does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the delivery period is exceeded in such a way that you cannot reasonably be expected to uphold the agreement. In that case you are entitled to cancel the order or to dissolve the agreement to the extent that this is necessary.
4.3 Delivery of the items takes place at the place and time when the items are ready for shipment to the customer.
5. Right of withdrawal
5.1 After the customer has received the ordered item, the customer is obliged to carefully inspect the products or have them inspected immediately upon receipt.
5.2 The consumer has the right to inform the seller that he is canceling the purchase, without paying a fine and without giving any reason within 14 days (this does not apply to custom-made hangers and / or designs) from the day the order has been delivered or on the conclusion of the service agreement. The customer must then return the item within 14 days. If the customer wishes to dissolve the agreement as a result of article 6.1 of these terms and conditions, you must notify Cloxstar in writing (via letter or e-mail). The customer must send the item to a return address determined by Cloxstar. The direct costs for the return shipment are for the account of the customer.
5.3 Cloxstar reserves the right to refuse returned items or to credit only a portion of the purchase amount if it is suspected that the item has already been opened, used or due to the fault of the customer (other than that of Cloxstar or the supplier of the item) is damaged.
5.4 If an article is returned that in the opinion of Cloxstar has suffered damage that is due to an action or negligence of the customer or that is otherwise at the risk of the customer, Cloxstar will inform the customer of this. Cloxstar has the right to withhold the depreciation of the item as a result of this damage from the amount to be reimbursed to the customer.
5.5 The purchase price of the part of the order that you have returned will be refunded to you. Shipping costs will not be reimbursed in that case.
5.6 Claims and defenses that the product delivered does not comply with the agreement will become time-barred after the lapse of six months after receipt by the customer.
5.7 Products that were on offer at the time the customer placed an order can only be exchanged and the 14-day money back guarantee does not apply.
5.8 You have a cooling-off period of 14 days to return the product without giving any reason, with the exception of ear fashion that will not be accepted for hygienic reasons. If you want to view the item (earrings), we can seal the earrings for you on request. Pay attention! earrings can be sealed (on request) once opened, you can no longer exchange the earrings.
6. Orders / Communication
6.1 In the event of misunderstandings, damage, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in traffic between the customer and Cloxstar, or between Cloxstar and third parties, insofar as these relate to the relationship between the customer and Cloxstar, Cloxstar is not liable.
7. Force majeure
7.1 Without prejudice to the other rights vested in it, Cloxstar has the right, in the event of force majeure, to suspend the execution of your order or to dissolve the agreement without judicial intervention, by notifying you in writing. and this without Cloxstar being obliged to pay any compensation, unless this would be unacceptable by the standards of reasonableness and fairness in the given circumstances.
7.2 Force majeure is understood to mean any shortcoming that cannot be attributed to Cloxstar, because it is not due to its fault and is not for its account under the law, legal act or generally accepted views.
7.3 Cloxstar has the right to invoke force majeure if any circumstance prevents (further) fulfillment.
8. Risk
8.1 The risk during transport of the product ordered by the customer is for Cloxstar. At the time of delivery of the product, or the moment that can reasonably be regarded as delivery, the risk of the product transfers to the customer, except for the liabilities that cannot legally be excluded by Cloxstar.
9. Guarantees
9.1 The products supplied by Cloxstar are exclusively covered by the guarantee as determined by the manufacturer of the relevant product. Cloxstar only performs a counter function during such a warranty period.
9.2 The products delivered by Cloxstar are guaranteed for a minimum of 3 and a maximum of 12 months from the date of purchase against manufacturing defects, unless stated otherwise. The following is excluded: crown, glass, lock, case, moving parts, stones / diamonds falling out, band and improper use. To use the service and warranty you must always have the paid original invoice that comes with the order.
9.3 Products with a 12-month warranty are clearly stated in the relevant product specification. In all other cases the guarantee is then fixed for a maximum of 3 months.
9.4 For hygienic reasons, earrings and grillz cannot be returned or exchanged, unless they are still unpackaged.
9.5 Swarovski Casio G-Shock watches are custom made watches and may not come into contact with water, this means showering, swimming, washing dishes etc. The warranty for the watch expires for the customer if the watch has been in contact with water.
10. Complaints
10.1 All complaints in connection with the delivery, quality, quality of the product or any other complaint will be taken seriously by Cloxstar.
10.2 The customer must make a written complaint to Cloxstar within fourteen (14) days.
10.3 Cloxstar will attempt to resolve the complaint within ten (10) working days. Cloxstar will inform the customer about this.

12. Rights
12.1 If you make a written statement to Cloxstar about a delivery address, Cloxstar is entitled to send all orders to that address, unless you make a written statement to Cloxstar from another address to which your orders must be sent.
12.2 If Cloxstar allows deviations from these conditions, whether tacitly or not, for a short or longer period, this does not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any right based on the fact that Cloxstar applies these Terms smoothly.
12.3 If one or more of the provisions of these terms and conditions or any other agreement with Cloxstar should conflict with any applicable legal provision, the relevant provision will lapse and be replaced by a new legally permissible comparable provision to be established by Cloxstar.
12.4 Cloxstar is authorized to make use of third parties in the execution of your order(s).
12.5 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, are exclusively governed by Dutch law.
12.6 All disputes between parties will be submitted exclusively to the competent court in The Netherlands.
12.7 All images, data regarding dimensions, colors, etc. are only approximate. Deviations from reality cannot be a reason for compensation and / or dissolution.
